Non Members Terms and Conditions of Hire

1. This agreement is between the “Hiree” whose details are set out overleaf and the “Hirer” who is “Friends of Pedal Power Project Ltd” and is operating on a not for profit basis, here after known as “Pedal Power”.
2. The Hiree acknowledges that they have seen a member of Pedal Power Staff and/or Pedal Power Volunteer(s) carry out a pre hire safety check on each cycle being hired and is fully satisfied that all safety critical components on the cycle(s) are fully serviceable at the commencement of the hire period.
3. The Hiree agrees to take reasonable care of the cycle(s) whilst in their possession and understands that the cycle(s) are not appropriate for “extreme off roading”, “down hilling” and “on road and off road race” competitions.
4. The Hiree warrants that all riders of cycle(s) under their control are competent to perform the act of cycling and will take responsibility for ensuring the safe use and operation of the cycles that they have hired.
5. The Hiree agrees to take reasonable care of all accessories hired with the bicycle and undertakes to return them on completion of the hire period.
6. The Hiree agrees to pay Pedal Power a deposit of £20.00 per bicycle and understands that the refunding of this deposit is conditional on the return of the cycle in a state equal to the condition that it was hired out in.  Fair wear and tear accepted.
7. The Hiree agrees to indemnify and defend Pedal Power against any claim howsoever caused as a result of the use or misuse of the hired cycle(s) whilst in the possession of the Hiree.
8. In the event of a cycle(s) being lost, damaged beyond economic repair or stolen whilst in possession of the Hiree.  The Hiree agrees to pay Pedal Power a sum equal to one third of the full retail cost of the cycle.  This will be refunded in full or part if the cycle is subsequently recovered in working order within 14 days of the loss; at the discretion of Pedal Power.
9. The Hiree agrees to inform Pedal Power immediately of any loss or breakdown of any cycle(s) in the possession or control of the Hiree except where the Hiree is able to reasonably repair the cycle themselves.
10. The Hiree agrees to report any repair or injury associated with the use of any cycle(s) in their control no later than the end of the hire period.
11. The Hiree agrees to limit any claim for any loss associated with the hire of cycle(s) to a sum equal to the hire charge for the affected cycle(s).
